2. Using Our Website

You may use rajatoqier.com for lawful purposes, including learning about our services, contacting us, requesting a quotation, or engaging our services.

You agree not to:

  • Use the website for unlawful or fraudulent activities.
  • Attempt to gain unauthorized access to the website or its systems.
  • Copy, reproduce, modify, or redistribute website content without permission.
  • Introduce malicious code, malware, viruses, or other harmful material.
  • Interfere with the normal operation or security of the website.
  • Misrepresent your identity or provide intentionally misleading information.

We reserve the right to restrict or terminate access to the website where we reasonably believe these Terms have been violated.

3. Service Enquiries and Project Agreements

Submitting an enquiry through our website does not automatically create a client relationship or guarantee that a project will be accepted.

Before starting a project, we may discuss:

  • Project requirements
  • Scope of work
  • Deliverables
  • Timeline
  • Pricing
  • Payment schedule
  • Required access
  • Client responsibilities
  • Revisions
  • Additional requirements
  • Other project-specific conditions

Where appropriate, these details will be documented in a proposal, quotation, message, email, freelancing-platform agreement, or other written communication.

The agreed project scope will take priority over general descriptions of services appearing on our website.

4. Project Scope and Additional Work

We aim to clearly define the scope of every project before work begins.

Work requested outside the agreed scope may be treated as additional work and may require:

  • Additional payment;
  • Additional delivery time; or
  • A separate project agreement.

Examples may include significant changes to the original requirements, additional pages, additional functionality, new integrations, extensive content changes, or requirements introduced after approval of the original scope.

We will generally discuss additional work with the client before proceeding.

5. Payments

We normally require a partial advance payment before starting a project.

The remaining balance may be paid progressively based on project milestones, regular updates, reports, or agreed stages, with the final balance generally becoming due upon completion of the agreed project work.

Payment arrangements may vary depending on the project and the platform used.

We may accept payments through:

  • Wise
  • Payoneer
  • Fiverr
  • Upwork
  • Other recognised freelancing or payment platforms
  • Other payment methods agreed with the client

A project may not begin until the agreed initial payment and required information/access have been received.

Where a payment platform has its own terms, those terms may also apply to the relevant transaction.

6. Project Delays

Project timelines depend on both parties.

We will make reasonable efforts to complete projects within the agreed timeframe. However, delays may occur where the client:

  • Does not provide required information;
  • Delays providing website or hosting access;
  • Does not provide required content;
  • Delays approvals or feedback;
  • Changes the project requirements;
  • Requests additional work; or
  • Becomes unavailable for an extended period.

Where delays are caused by circumstances outside our reasonable control, the delivery timeline may need to be adjusted.

7. Client Responsibilities

To allow us to complete a project effectively, clients are responsible for providing accurate and complete information relevant to the project.

Depending on the service, clients may need to provide:

  • Website or CMS access
  • Hosting or cPanel access
  • Domain access
  • Google or analytics access
  • Advertising account access
  • Social media/platform access
  • Business information
  • Product or service information
  • Content and branding information
  • Required approvals and feedback

Clients are responsible for ensuring that the information and materials they provide are accurate and that they have the legal right to use them.

Clients are also responsible for ensuring that their website, products, services, business activities, and content comply with applicable laws and regulations.

8. Website, Hosting and Third-Party Access

Some projects require access to third-party platforms such as WordPress, Shopify, WooCommerce, Elementor, Google, Meta, hosting providers, analytics platforms, advertising platforms, or other services.

We will use provided access only as reasonably necessary to perform the agreed work.

Clients should provide appropriate access rather than sharing unnecessary personal or financial information.

Where we purchase hosting, domains, plugins, themes, or other third-party services on behalf of a client, the relevant third-party provider’s terms, pricing, renewal policies, and licensing conditions may also apply.

9. Website Security and Backups

Where backup services are included in the agreed project scope, we will take reasonable steps to create or maintain appropriate backups during the relevant project.

However, clients should maintain appropriate long-term backups of their websites, databases, files, content, and business information.

We cannot guarantee that every backup will remain available indefinitely or that a third-party hosting provider or platform will preserve all data.

10. Revisions and Client Approval

Revisions included in a project will depend on the agreed scope and proposal.

Clients are expected to review and provide feedback on work delivered for approval.

Once a client approves a design, page, website section, implementation, or other deliverable, subsequent changes may be considered additional work if they fall outside the agreed scope.

Client approval is an important part of the project process and may affect delivery timelines.

11. Intellectual Property and Ownership

Unless otherwise agreed in writing, Raja Toqier retains ownership of the underlying intellectual property used to create and deliver our services.

This includes, where applicable:

  • Our original code
  • Reusable code components
  • Frameworks
  • Development methods
  • Templates
  • Systems
  • Workflows
  • Technical processes
  • Scripts
  • Libraries
  • Reusable design structures
  • Internal tools
  • SEO methodologies
  • Strategies
  • Techniques
  • Know-how

A client does not acquire ownership of our underlying reusable systems, methodologies, frameworks, templates, or intellectual property merely by purchasing a service.

For example, where a client likes the structure or functionality of a previous project, we may reuse our existing technical framework or code and adapt it to meet the new client’s requirements.

12. Client Use of Completed Work

After the agreed project has been fully paid for, the client may use the completed work created specifically for their project for their own business purposes, subject to the terms of the project agreement.

This does not transfer ownership of Raja Toqier’s underlying reusable code, systems, frameworks, methods, templates, or intellectual property.

Any third-party software, plugins, themes, fonts, images, stock assets, APIs, or other licensed materials remain subject to their respective licensing terms.

Where a specific project requires different ownership or licensing arrangements, those arrangements should be agreed upon in writing before or during the project.

13. Third-Party Assets and Licenses

Where appropriate and included within the project scope, we may source or purchase legally licensed:

  • Images
  • Fonts
  • Themes
  • Plugins
  • Software
  • Stock assets
  • Other digital resources

Third-party assets may remain subject to the licensing terms of their respective providers.

We will make reasonable efforts to use properly licensed resources when we are responsible for sourcing them.

Clients remain responsible for ensuring that any materials they independently provide to us are legally permitted for use.

14. Portfolio and Previous Work

Raja Toqier may display completed work, screenshots, website designs, or project examples in our portfolio, website, marketing materials, or professional profiles unless a different confidentiality arrangement has been agreed in writing.

Our website may contain examples of previous work for demonstration purposes.

You can view our portfolio on the website’s portfolio section.

15. SEO, AIO, GEO and AI Search Services

We use ethical, sustainable, and generally white-hat SEO and optimization practices when providing SEO, AIO, AEO, GEO, AI Search, and related services.

Our objective is to improve a website’s visibility, technical quality, relevance, discoverability, and overall search performance.

However, search engines and AI platforms are independent third-party systems. Their algorithms, ranking systems, indexing processes, AI responses, citations, visibility, and policies can change at any time.

Therefore, we do not guarantee a specific ranking, traffic level, AI visibility score, citation, conversion rate, indexing result, or business outcome.

This does not mean that results are unlikely. Our approach is designed to create sustainable improvements and reduce unnecessary risk by following accepted and ethical optimization practices.

However, no SEO or AI optimization professional can reasonably guarantee permanent results because external platforms remain outside our control.

16. Search Engine and AI Platform Changes

Our services may target platforms and systems including, but not limited to:

  • Google Search
  • Google AI Overviews
  • Google Analytics
  • Gemini
  • ChatGPT
  • Claude
  • Other AI search or generative platforms
  • Search engines
  • Answer engines
  • Other third-party digital platforms

These platforms may independently change their algorithms, ranking systems, policies, interfaces, indexing processes, data sources, or AI models.

We are not responsible for negative changes resulting solely from an external platform’s algorithm update, policy change, technical failure, service interruption, or other action outside our reasonable control.

Where an ongoing service agreement is in place, we will make reasonable efforts to assess significant changes and adjust our strategy where appropriate.

17. Google Ads, Analytics, Tracking and Advertising Platforms

We may provide setup and implementation services involving Google Ads, Google Analytics, Google Tag Manager, Meta/Facebook Pixel, conversion tracking, ecommerce tracking, and other advertising or analytics technologies.

We aim to implement these systems according to the agreed requirements and available platform functionality.

However, third-party platforms may change:

  • Tracking methods
  • APIs
  • Reporting
  • Attribution
  • Data processing
  • Account policies
  • Advertising policies
  • Interfaces
  • Measurement methodologies

We cannot guarantee that third-party reporting or tracking will remain unchanged after implementation.

Advertising performance, leads, sales, conversions, and return on advertising spend are also not guaranteed unless a specific written agreement states otherwise.

18. Third-Party Platforms

Our services may involve third-party platforms, including WordPress, Shopify, WooCommerce, Elementor, Google, Meta, hosting companies, plugins, themes, APIs, AI platforms, and other technology providers.

We are not the owner or operator of these third-party platforms.

We cannot guarantee the continued availability, functionality, pricing, security, compatibility, policies, or performance of third-party services.

If a third-party platform experiences an outage, policy change, account restriction, API change, algorithm update, incompatibility, or other issue, additional work may be required to adapt the project.

Where an issue results from a third-party service that we specifically recommended or implemented, we will make reasonable efforts to assist with resolving or adapting to the issue within the agreed scope.

19. Refunds

We aim to resolve project issues fairly and professionally.

A refund may be considered where:

  • The issue was caused by a significant mistake on our part;
  • There was a material misunderstanding or miscommunication about the agreed project requirements; or
  • We are unable to deliver the agreed work for reasons attributable to us.

Where appropriate, we will first attempt to correct the issue or provide a reasonable solution.

Refunds are evaluated based on the specific circumstances, work already completed, payments received, and the agreed project scope.

20. Project Cancellation

Either the client or Raja Toqier may request termination of a project where the project can no longer reasonably proceed according to the original agreement.

Examples may include:

  • Significant changes to the original requirements;
  • Unresolved disagreements regarding the project;
  • Lack of required cooperation or access;
  • Material changes to project circumstances;
  • Other circumstances that make continuation unreasonable.

If a client cancels after work has started and the parties cannot reach another agreement, up to 50% of the amount paid may be refunded, depending on the amount of work already completed and project circumstances.

Work that has already been completed, purchased, delivered, or committed to third-party costs may affect the final refund amount.

21. Limitation of Responsibility After Project Completion

Once a project has been completed, delivered, approved, and paid for, Raja Toqier is generally not responsible for subsequent changes, losses, or issues caused by circumstances outside the original project scope.

This may include:

  • Loss of revenue
  • Loss of data
  • Business interruption
  • Search traffic changes
  • Search ranking changes
  • AI visibility changes
  • Website changes made by the client or another developer
  • Hosting problems
  • Plugin/theme conflicts
  • Third-party platform changes
  • Security incidents occurring after project completion
  • Changes made to advertising, analytics, or other third-party accounts

Where we continue to provide an ongoing service or maintenance agreement after completion, responsibility will be determined according to the scope of that ongoing service.

22. Security

We take reasonable technical precautions when working on client websites and systems.

However, no website, hosting environment, software platform, plugin, API, or online system can be guaranteed to be completely secure.

We are not responsible for security incidents resulting from:

  • Third-party vulnerabilities;
  • Compromised hosting accounts;
  • Weak or reused passwords;
  • Unauthorized access by third parties;
  • Client actions;
  • Vulnerable plugins or themes outside our control;
  • Security issues introduced after project completion; or
  • Other circumstances outside our reasonable control.

Where an ongoing maintenance or security service is agreed, the applicable project agreement will determine our responsibilities.

23. Confidentiality

We respect the confidential nature of client information.

Information provided to us for the purpose of completing a project will generally be used only as reasonably necessary to provide the agreed services, except where disclosure is required by law or reasonably necessary to work with relevant service providers.

Clients may request additional confidentiality or non-disclosure arrangements where required for a specific project.

24. Privacy and Personal Information

We may collect information such as:

  • Name
  • Email address
  • Phone number
  • Business information
  • Contact-form submissions
  • Project requirements
  • Website information
  • Analytics information
  • Other information voluntarily provided by visitors or clients

We may also use technologies such as cookies, Google Analytics, Google Tag Manager, Meta Pixel, and similar technologies.

Our handling of personal information is explained in our separate Privacy Policy.

25. Client Legal Compliance

Clients are responsible for ensuring that their business, website, products, services, advertising, content, and activities comply with all applicable laws and regulations in the jurisdictions in which they operate.

We provide technical, design, development, SEO, tracking, and digital marketing services. Unless specifically agreed otherwise, we do not provide legal, tax, financial, regulatory, or compliance advice.

Clients should obtain appropriate professional advice where required.

26. No Guarantee of Business Results

Our services are intended to improve the technical, visual, marketing, tracking, search, or digital performance of a client’s website or online presence.

However, business results depend on many factors outside our control.

We therefore do not guarantee:

  • A specific amount of revenue;
  • A specific number of leads;
  • A specific number of sales;
  • A specific search ranking;
  • A specific amount of traffic;
  • A specific advertising return;
  • A specific conversion rate;
  • A specific AI visibility level; or
  • Any particular commercial outcome,

unless such outcome has been expressly agreed in a separate written agreement.

27. Force Majeure

We will not be considered responsible for delays or failures caused by circumstances reasonably outside our control.

These may include:

  • Internet or hosting outages;
  • Platform outages;
  • Cybersecurity incidents;
  • Government actions;
  • Natural disasters;
  • Power failures;
  • War or civil unrest;
  • Widespread technical failures;
  • Third-party service interruptions;
  • Major software or platform changes; or
  • Other circumstances beyond our reasonable control.

Where possible, we will communicate significant delays and work toward a reasonable solution.
